Your participation in the Pay by Bank Program (the "Program") and your Pay by Bank payment tender is subject to these Terms and Conditions (the "Agreement"). Your participation in the Program is also governed by our paylessdailyonline.com Terms of Use found here which incorporate our Privacy Policy. We may update these terms from time to time by posting updates on the paylessdailyonline.com website. By using this service, you accept the updated terms.
Participation in the Program allows you to register for the Program and tie your bank account information to your Payless Daily Account to initiate payment for purchase transactions at paylessdailyonline.com or SamsClub.com, which may be accessed on-line or through the Payless Daily App or Sam's Club App. In summary, this service allows you to initiate a transfer of funds directly from your bank account to pay for goods or services.
Eligibility. You are eligible to register for the Program if you are 18 years of age or older and you have an eligible bank account. The Agreement is in addition to any agreement you may have with your Bank. We reserve the right, in our sole discretion, to impose limits on the amount of funds sent through this service, on a per transaction or cumulative basis. There may also be limits on the frequency and number of transactions that may be made by Pay by Bank.
Registration. To register for the Program, you must complete the Program Registration process. We reserve the right to deny your Program Registration, to reject your payment under the Program, and to terminate your ability to particpate in the Program for any reason and in our sole discretion. You may terminate your participation in the Program by deleting the Pay by Bank payment tender from your Payless Daily Account Payment Options page. You may also terminate your participation in the Program by calling your Bank to revoke authorization.
Authorization. This authorization applies to your Pay by Bank payment initiation that allows you to initiate a transfer of funds directly from your tied bank account to Payless Daily or a Payless Daily affiliate. By selecting the Pay by Bank payment tender, you authorize us to electronically debit your bank account up to the total amount of your purchase, including applicable taxes, fees, and shipping or delivery costs. You also authorize us to further debit or credit your bank account to correct any errors, make any necessary adjustments to your payment, or issue a refund back to your bank account.
Payment Returns. If your bank returns any payment using your bank account unpaid, we may retry the payment. You authorize our payment processor to collect a Returned Transaction Fee as an electronic fund transfer or draft if permitted by law. You also agree that the laws of the State of Georgia govern the Returned Transaction Fee and the collection thereof for online and in app purchases. The fee for online and in app Returned Transactions is $30.00. Your bank may also charge you an overdraft or other fees for payment failure.
Account Management. It is your responsibility for safeguarding your User Identification, Password, and any other credentials used to access these services on our website or mobile app. You are responsible for any activity occurring in your account (including, without limitation, any activity by additional users of your account). If you become aware of any unauthorized access to your account, please notify Payless Daily and your bank immediately.
You must keep the email address, contact information, and payment details associated with your account current and accurate.Â
